Alan Kirk comes to Babst Calland with more than twenty-five years experience in private practice representing business and commercial clients in central Pennsylvania, and as a former Assistant District Attorney. Mr. Kirk has significant litigation experience involving compliance and permitting matters before the Environmental Hearing Board and the Federal Court on behalf of numerous coal companies and other businesses. He represents banks, financial institutions in commercial transactions, risk assessment and due diligence guidance as well as general litigation involving creditor rights protection. Mr. Kirk presently acts as special counsel for publicly traded gas and oil companies on resource development issues. He has significant land use experience on behalf of oil and gas companies in both central and northeastern Pennsylvania. Currently, his practice focuses on real estate, commercial and environmental law matters affecting energy companies, financial institutions, land developers, title companies and other businesses. In addition, as a licensed title agent he assists in the management of MidState Closing Company, a firm affiliate, providing real estate settlement services.
Background
Mr. Kirk received his B.A. from The Pennsylvania State University in 1976 and his Juris Doctor from the New England School of Law in 1982. While in law school he was selected to be a Judicial Intern with the Massachusetts Superior Court.
Memberships and Affiliations
Mr. Kirk is admitted to practice in Pennsylvania, the Western District of Pennsylvania, the Court of Appeals for the Third Circuit, and the Supreme Court of the United States. He is a member of the Environmental Mineral and Natural Resources Law Section, and the Real Property, Probate and Trust Law Sections of the Pennsylvania Bar Association, and a member of the Centre County Bar Association. Mr. Kirk was Secretary/Treasurer of the Clearfield County Bar Association from 1986 to 1994, on the Board of Directors for Keystone Legal Services, Inc. from 1988 to 1994, and a Member of the Board of Trustees for Mt. Aloysius College in Cresson, PA from 1994 to 2003. He is a Fellow of the Litigation Counsel of America and is an instructor of Forensic Evidence at The Pennsylvania State University.
