Area of Emphasis
David McKenery concentrates his practice on construction litigation, toxic tort litigation and complex commercial litigation. Mr. McKenery has represented a broad spectrum of local and national companies confronting construction delays, construction payment disputes, environmental cost recovery claims under RCRA, CERCLA and state law statutes, and breach of contract matters. He has acted as counsel in state and federal courts and before arbitration panels. Mr. McKenery has also assisted clients to avoid litigation and positioned clients to prepare for litigation.
Additionally, Mr. McKenery provides general corporate counseling to an architectural and engineering firm and a full service construction company. He has helped tailor construction project delivery systems, addressed regulatory considerations and negotiated and structured a host of commercial agreements.
Background
Mr. McKenery graduated magna cum laude from Duquesne University with a B.S. in Business Administration. He received his J.D. from Duquesne University, where he graduated cum laude and served on the Editorial Board of the Duquesne Law Review. While in law school, Mr. McKenery also completed an externship with the Honorable Joy Flowers Conti of the United States District Court for the Western District of Pennsylvania and served as a legal research assistant to Professor Kenneth E. Gray. Prior to joining Babst Calland, Mr. McKenery was an attorney in one of Pittsburgh’s largest law firms.

Mr. McKenery is admitted to the Pennsylvania Bar and is a member of the Allegheny County, Pennsylvania and Federal Bar Associations. His other affiliations have included the National Trial Advocacy College at the University of Virginia, Family House and The Mattress Factory.
