Mark K. Dausch

Mark Dausch is a shareholder and co-chair of the Litigation Group of Babst Calland. He is also a member of the Firm’s Energy and Natural Resources Group. Mr. Dausch specializes in energy, environmental, products liability and commercial litigation. As lead trial counsel, Mr. Dausch has tried bench and jury trials to verdict in state and federal courts, alternative dispute resolution forums and before government agencies.
Mr. Dausch’s energy litigation experience includes defending oil and gas producers and contractors in personal injury, toxic tort, nuisance and lease dispute claims and in zoning and local government litigation. His environmental litigation experience includes representing businesses in claims before the Pennsylvania Environmental Hearing Board, including environmental permit appeals and water quality, civil penalty and mine subsidence claims. He also represents businesses in environmental cost recovery cases under federal and state environmental laws.
In addition, Mr. Dausch has defended heavy machinery, industrial equipment, medical device, chemical and construction product manufacturers in product liability claims. He has also represented businesses in a wide variety of complex commercial litigation matters involving contract, warranty, tortious interference, fraud, antitrust, unfair trade practices, shareholder dispute claims and claims under the Americans with Disabilities Act.
Mr. Dausch graduated summa cum laude from Duquesne University with a B.S. in Business Administration, concentrating in Economics. He received his J.D. from Duquesne University, where he graduated magna cum laude and served on the Editorial Board of the Duquesne Law Review. While in law school, Mr. Dausch also completed an externship with the Honorable David Stewart Cercone of the United States District Court for the Western District of Pennsylvania and served as a legal research assistant to Professor Kenneth E. Gray.
Memberships and Affiliations
Mr. Dausch is admitted to practice in Pennsylvania and West Virginia, and is a member of the Allegheny County, Pennsylvania and American Bar Associations. Mr. Dausch is an adjunct professor of law at Duquesne University and currently serves as a member of the Duquesne University Economic Advisory Board.
In 2013, Mr. Dausch was selected by The Legal Intelligencer as one of only 38 “Lawyers on the Fast Track” in Pennsylvania. This recognition is given to attorneys under the age of 40 who have demonstrated excellence in four categories: development of the law, advocacy and community contributions, service to the bar and peer/public recognition. In addition, on multiple occasions, Mr. Dausch has been recognized as one of Pennsylvania’s up-and-coming lawyers, according to an annual survey published in Philadelphia magazine.
