Mineral Title Services

For three decades, Babst Calland has offered clients a multi-disciplinary approach to providing legal services to the domestic energy, oil, gas and mining industries. As one of the region’s most respected energy law firms, we represent clients in land, transactional, environmental and litigation matters pertaining to the natural gas, coal, oil and aggregate industries.
We cover all aspects of the title examination and analysis process, including full and limited title examination and title due diligence. Our oil and gas title examination and analysis services include:

  • Full drilling title opinions
  • Acquisition title opinions
  • Division order opinions
  • Due diligence review of title
  • Curative measures required to clear and release locations

Because our oil and gas attorneys regularly structure, draft, review and negotiate contracts relating to the production and development of exploration projects, including preparation of drilling & operating agreements, development agreements, joint operating agreements, cooperation agreements, AMIs, farmout agreements, and term assignments, our title examination brings with it the depth and experience necessary to provide value to our clients.

We assist in the seller’s preparation for a sale, the buyer’s preparation for an acquisition, the negotiation of the purchase and sale agreement, the due diligence process, all ancillary documents leading up to the closing, and on post-closing matters as well.

To provide for efficient delivery of legal services, we have assisted our clients in preparing specific field documents tailored to a particular region or a complete exploration project that can be used by a land department with minimal additional modification by in-house counsel. These template documents and projects include oil and gas leases, memoranda of leases, affidavits, letters of intent, purchase agreements, and term assignments.

“Mineral and surface title analysis and examination is an esoteric and comprehensive area of the law and one that has its own distinct terminology, law and procedures. Babst Calland’s title attorneys are equipped with the knowledge and understanding of the needs of our E&P and mistream clients to help guide them through to clearing title and releasing locations for development.”
