Scott K. McKernan

Area of Emphasis

Scott McKernan is a shareholder in the Energy and Natural Resources and Land and Energy Title groups of Babst Calland. Mr. McKernan concentrates his practice in the Oil and Gas and Renewable Energy industries. He counsels energy clients on title and property development and transactions. Mr. McKernan focuses his practice in the development and siting of energy generation projects, and the acquisition, divestiture or trade of assets, with a concentration in title examination and curative matters, property development rights and issues related thereto, operations, contractual issues, due diligence and litigation support. His representation in transactional matters includes leasing and easement agreements, purchase and sale and trade agreements, and other agreements regarding operations and maintenance.


Mr. McKernan earned his B.A. in Mathematics with a minor in Education from St. Vincent College in 2004. While at St. Vincent, he was a member of Alpha Lambda Delta, an academic honor society, and Kappa Delta Pi, an international education honor society. He graduated from Duquesne University School of Law in 2007.

Mr. McKernan is active in representing members of the community on a pro bono basis. He has participated in the Criminal Records Expungement Project through the Pittsburgh Pro Bono Partnership and Neighborhood Legal Services, where he has helped clients through the process of having their criminal records cleared to the extent permitted by law for the purpose of obtaining housing and employment.

Mr. McKernan is admitted to practice in New Mexico, Ohio, Oklahoma, Pennsylvania, Texas and West Virginia. He is a member of the American Bar Association and the ABA’s Environment, Energy and Resources Group and the bar associations of the states in which he practices, as well as the Environment & Energy Law Section of the Allegheny County Bar Association.

Mr. McKernan is also a member of the Energy & Mineral Law Foundation (EMLF), Rocky Mountain Mineral Law Foundation (RMMLF), American Association of Professional Landmen (AAPL) (including the Michael Late Benedum Chapter (MLBC) and Houston Area Chapter (HAPL) of the AAPL), Ohio Oil and Gas Association (OOGA) and Northern Appalachian Landman’s Association (NALA).


Mr. McKernan has been published and regularly presents on topics related to the energy industry before professional organizations and also in-house audiences.
