DESCRIPTION:Municipal Attorneys Betsy Dupuis and Morgan Madden will present “Who\, What\, When\, and Why of Authority Rules and Regulations” to the Pennsylvania Municipal Authorities Association on Wednesday\, October 15\, 2025. Most municipal authorities in the Commonwealth have some iteration of rules and regulations to govern and guide the use of equipment\, services provided\, and authority-owned facilities. Sometimes these regulations simply cover the basics including fees for tapping\, services\, etc.\, and yet other municipalities have more robust regulations that dictate\, for example\, how repairs are to be completed and who is responsible for costs associated with the same. As a general rule\, authorities should regularly review their rules and regulations and ensure that those rules and regulations are sufficient and enforceable based upon current operations and services\, and ensure both the system and the authority are protected from unauthorized actors and a constantly evolving legal and regulatory landscape. At least 18 states have “legalized” the recreational use of cannabis. To date\, federal law continues to classify cannabis as a Schedule 1 substance defined as “drugs with no currently accepted medical use and a high potential for abuse.” The conflicting legal regimes create uncertainty for employers. This presentation will review state and federal laws relating to cannabis and discuss some noteworthy court decisions. \nLitigation Attorneys Steve Silverman and Katerina Vassil will co-present “Legal and Practical Hurdles Surrounding Lithium: The Next Extraction Revolution.” As E&P companies explore participating in lithium extraction from produced water\, they face many legal and business hurdles but recognize that the benefits may be tremendous. This presentation addresses how to use expert witnesses most effectively\, including their expert reports\, qualifications\, and direct and cross examination. \nBetsy Dupuis – “Land Use/Zoning Law Update”\nDevelopment in Pennsylvania\, including most projects involving environmental issues\, is governed by the Municipalities Planning Code and local zoning and land use laws. The application of local land use laws frequently involves the interplay of those laws with state and federal law. This session will review significant land use cases decided over the last year in Pennsylvania\, with a focus on review standards\, standing requirements\, preemption doctrine and constitutional law. The Spring Conference brings top practitioners\, experts\, and thought leaders together for a deep dive into some of the most compelling and timely topics in the field of environment\, energy\, and resources law. \nEnvironmental Attorney Christina Puhnaty will serve as the moderator for “All the Latest HAPpenings: The Transformation of the Clean Air Act’s Air Toxics Program.” Nearly 35 years after it was strengthened as part of the 1990 Clean Air Act (CAA) amendments\, the CAA’s air toxics program is being reshaped and expanded significantly to add unregulated air toxics\, remove affirmative defenses\, and address environmental justice. In the last four years\, the EPA has revised numerous National Emission Standards for Hazardous Air Pollutants for the chemical\, power\, steel and iron-making\, commercial sterilization\, and other industrial sectors. The EPA is advancing policy-based rulemakings to add unregulated Hazardous Air Pollutants (HAPs) to the air toxics rules\, making it more difficult for sources to reclassify as area (i.e.\, lower-emitting) sources\, and strengthen emissions limitations and work practice standards. Fenceline monitoring and community risk models are being touted to promote environmental justice.
