DESCRIPTION:Attorneys Kip Power and Shannon Rutherford will present “Clean Water Act Sections 401\, 404 and 505: Citizen Suits Based on Water Quality Certifications for Energy Projects\,” at WVU College of Law’s Shale Gas Law 2019 on November 8-9\, 2019. \nA state must issue a water quality certification under Clean Water Act Section 401 in order to make effective any federal permit issued under other Clean Water Act provisions that authorize discharges into waters of the United States. Energy projects often require permits under Clean Water Act Section 404 to allow the lawful placement of fill material into jurisdictional waters. Pursuant to Clean Water Act Section 505\, citizen suits may be commenced against entities that are in violation of an “effluent standard or limitation\,” including “certification under [Clean Water Act Section 401].” This presentation will explore the extent to which conditions that are attached to Section 401 Certifications may serve as a basis for Clean Water Act citizen suits\, and the ramifications of this potential exposure for those seeking to construct energy projects. DESCRIPTION:Attorneys Kathy Condo and Blaine Lucas will co-present “Opposition to Shale Gas and Other Extractive Industries Continues to Grow at the Local Level” at EMLF’s 40th Annual Institute\, June 9-11\, 2019. Townhall settings have become ground zero for efforts to restrict unconventional shale development. NGOs have used Pennsylvania’s Environmental Rights Amendment to not only oppose operator zoning applications\, but also to seek the invalidation of ordinances permitting industry activity. Many of these proceedings have evolved into battles of the experts\, without the procedural safeguards existing in civil litigation. In West Virginia\, local governments have attempted to restrict or ban extractive industries by adopting nuisance ordinances. Ohio activists continue to use referenda to implement restrictive ordinances. Federal and state preemption of local regulation has been the subject of litigation in many jurisdictions. With the renewed emphasis on climate change and Pennsylvania’s Environmental Rights Amendment (ERA) in recent years\, it is not surprising that a new proposal has been submitted to the Pennsylvania Environmental Quality Board\, the board responsible for promulgating environmental regulations in Pennsylvania. The proposal is based on a California model\, a state that often marks a new path regarding environmental initiatives. This session will look at the Pennsylvania proposal in detail\, compare it to other cap and trade models\, and consider this among other proposals being advanced related to climate change and the ERA.
