SUMMARY:PHMSA Regulations and Enforcement: What's Next for Pipeline Safety?
DESCRIPTION:Babst Calland joins Kinetic for “PHMSA Regulations and Enforcement: What’s Next for Pipeline Safety?” on Wednesday\, December 6\, 2017. \nThe Pipeline and Hazardous Materials Safety Administration (PHMSA) is almost a year into its transition to a new Administration.  As the months pass\, questions abound on the prospects for the numerous rulemakings currently underway at the agency.  Numerous rules were prompted by statutory mandates from the 2011 and 2016 amendments to the Pipeline Safety Laws\, while others reflect policy determinations of the outgoing administration. \nAttorneys James Curry and Brianne Kurdock will be presenting an update on PHMSA rulemakings and policies. This course will specifically focus on the enforcement regime governing pipeline safety at the federal level and provide an update on PHMSA rulemaking proceedings. \nJames Curry \nBrianne Kurdock \n

SUMMARY:Pipe Up: Pipeline Safety\, Regulatory and Operational Experts Share Their Knowledge
DESCRIPTION:The significance of pipeline safety has grown dramatically in recent years\, primarily as a result of the development of the nation’s shale plays and the need for new infrastructure to get gas to market\, specifically in the northeast. This growth in development has spurred new regulations from The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) and the state Pipeline Utility Commissions. Additionally\, environmental organizations have mobilized at the local level to block major pipeline projects\, making the need or safe operations and good public relations even more critical. \nThis Marcellus Shale Coalition seminar will include an update on the recent federal and state regulatory developments\, operator case studies highlighting safe pipeline installation\, monitoring and incident response. In addition\, a panel of public relations experts will share techniques on addressing safety issues during pipeline development. \nAttorneys Keith Coyle and Brianne Kurdock will be co-presenters at the “PHMSA Update: The Megarule\, Gas Storage\, and Other Recent Developments” session. In 2016 PHMSA published a sweeping rulemaking proposal on gas gathering and transmission lines\, “The Megarule.” Later that year\, the Obama Administration signed the Protecting our Infrastructure of Pipelines and Enhancing Safety Act\, or PIPES Act\, that reauthorized PHMSA’s pipeline safety program through 2019. This session will include an update on the rulemaking\, the PIPES Act\, and other recent developments at PHMSA under the Trump Administration and how it will affect the oil and gas industry. \nKeith Coyle will also be the moderator for the “State Update:  Ohio\, West Virginia\, and Pennsylvania” session. \nFor more information or to register\, click here. \nKeith Coyle \nBrianne Kurdock \n

SUMMARY:MSC Pipeline Safety Seminar: PHMSA Rulemaking Update
DESCRIPTION:In April 2016\, the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (“PHMSA”) published a long-anticipated rulemaking proposal for gas gathering and transmission lines. More than four years in the making\, the proposed rules would significantly expand PHMSA’s jurisdiction over gas gathering lines and add several new requirements to the agency’s regulations for gas transmission lines. Many of these proposals respond to congressional mandates and recommendations issued by the National Transportation Safety Board. In June 2016\, President Obama also signed the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2016\, or PIPES Act\, which reauthorizes PHMSA’s pipeline safety program through 2019. The PIPES Act contains several noteworthy provisions\, including a new rulemaking mandate for underground gas storage facilities and a provision authorizing PHMSA to issue industry-wide emergency orders if an unsafe condition or practice presents an imminent hazard to health\, property\, or the environment. Finally\, PHMSA is working to finalize a number of other rulemaking proposals and initiatives before the Obama Administration draws to a close in January 2017. \nIn order to better understand the implications of the proposed rulemakings and new provisions in the PIPES Act\, the seminar given by the Marcellus Shale Coalition in conjunction with its Midstream and Pipeline Committee will feature a series of presentations on current issues in pipeline regulation and operations\, as well as a roundtable discussion led by a panel of industry experts and government officials. These presentations will target the impacts that these proposed rulemakings will have on the pipeline and midstream sector developments in the Marcellus and Utica shale plays. \nPHMSA Rulemaking and Legislative Update\nFor more information click here. \nKeith Coyle \nJames Curry \nBrianne Kurdock

DESCRIPTION:Babst Calland Shareholder\, Jean Mosites will be presenting at the Air & Waste Management Association\, Allegheny Mountain Section Luncheon on November 10\, 2016. \nIn 1978\, EPA’s first proposed hazardous waste regulations under RCRA contained a carve-out for “oil and gas drilling muds” and “production brines” exempting them from storage\, treatment and disposal standards to which hazardous wastes were subject.  EPA justified the classification because such wastes were high in volume and low in toxicity.  In 1980\, RCRA was amended to exempt drilling fluids\, produced waters\, and other wastes associate with the exploration\, development or production of oil and gas\, pending study and determination by EPA\, which subsequently determined that \nBabst Calland Shareholder\, Jean Mosites will be presenting at the Air & Waste Management Association\, Allegheny Mountain Section Luncheon on November 10\, 2016. In 1980\, RCRA was amended to exempt drilling fluids\, produced waters\, and other wastes associate with the exploration\, development or production of oil and gas\, pending study and determination by EPA\, which subsequently determined that regulation under RCRA subtitle C was not warranted.  EPA\, however\, has recently been challenged by a coalition of NGO’s alleging that EPA failed to perform required triennial reviews required under subtitle D of RCRA. \nThis presentation will address the scope of the exemption as it has existed and evolved since 1988\, consider various liability scenarios for the handling of such waste under applicable law\, and review some of the implications of current legal challenges.
