SUMMARY:MSC Pipeline Safety Seminar: PHMSA Rulemaking Update
DESCRIPTION:In April 2016\, the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (“PHMSA”) published a long-anticipated rulemaking proposal for gas gathering and transmission lines. More than four years in the making\, the proposed rules would significantly expand PHMSA’s jurisdiction over gas gathering lines and add several new requirements to the agency’s regulations for gas transmission lines. Many of these proposals respond to congressional mandates and recommendations issued by the National Transportation Safety Board. In June 2016\, President Obama also signed the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2016\, or PIPES Act\, which reauthorizes PHMSA’s pipeline safety program through 2019. The PIPES Act contains several noteworthy provisions\, including a new rulemaking mandate for underground gas storage facilities and a provision authorizing PHMSA to issue industry-wide emergency orders if an unsafe condition or practice presents an imminent hazard to health\, property\, or the environment. Finally\, PHMSA is working to finalize a number of other rulemaking proposals and initiatives before the Obama Administration draws to a close in January 2017. \nIn order to better understand the implications of the proposed rulemakings and new provisions in the PIPES Act\, the seminar given by the Marcellus Shale Coalition in conjunction with its Midstream and Pipeline Committee will feature a series of presentations on current issues in pipeline regulation and operations\, as well as a roundtable discussion led by a panel of industry experts and government officials. Bluedorn II will discuss some of the practical legal issues associated with selling a former coal-ﬁred electric generating station\, with a particular focus from the seller’s perspective. Justin Ackerman will discuss the primary commercial issues in the transaction and some of the typical seller and buyer goals. Don Bluedorn will then discuss some of the unique environmental regulatory issues in the transaction\, including the application of US EPA’s CCR (coal combustion residuals) Rule which was ﬁnalized in 2015. \n\nKevin Garber \nRecent Developments in Oil and Natural Gas Wastewater Regulation\nThe management of ﬂowback\, produced ﬂuid\, and other oil and gas wastewater continues to be a signiﬁcant industry concern as the pace of new drilling slows with lower natural gas prices.  The presentation by Kevin J. Garber and Michael K. Reer summarizes federal and state regulatory initiatives with the potential to make oil and natural gas wastewater treatment and/or disposal more heavily regulated.  With respect to wastewater treatment\, suggested topics of conversation include  EPA’s proposal to formally prohibit publicly owned water treatment plants from accepting wastewater from unconventional wells\, EPA’s ongoing study of the centralized wastewater treatment industry and operator handling of wastewater\, EPA’s draft hydraulic fracturing assessment\, and the recently adopted amendments to Pennsylvania’s Chapter 78 as they apply to wastewater management.  Wastewater disposal topics include EPA’s new guidance on reducing the risk of induced seismicity\, the U.S. Geological Survey’s preliminary model for forecasting induced seismic events\, and the States First primer on managing permit conditions to reduce the risk of induced seismicity.
