DESCRIPTION:Babst Calland joins the Institute for Energy Law and the Energy & Mineral Law Foundation (EMLF) at the 15th Appalachia Energy Law Conference (f/k/a Law of Shale Plays Conference)\, September 4-5\, 2024. Focused on legal issues related to onshore energy production\, primarily oil and gas production in Appalachia\, this conference brings together clients\, attorneys\, professional landmen\, and other professionals to learn and discuss important cases\, concepts\, and trends. In addition\, the conference features multiple networking opportunities with other attendees. \nAttorney Jim Chen will be a co-panelist for the “New Opportunities in the Emerging Transportation and Energy Sector” session. New technologies have emerged with the increasing growth of alternative energy into the grid mix. These new technologies expressly include the use of energy storage in the form of lithium-ion batteries that have proven to be a resilient and reliable option to store energy to even the flow of generation from intermittent sources such as wind and solar. The battery technology has also proven helpful in grid stabilization\, supplemental sources for peak demand\, and backup power in cases of failures. With the increasing demand for this technology growing in several sectors (e.g.\, electric vehicles as well as stationary application)\, questions have arisen regarding the sourcing of the raw materials and processing of minerals to manufacture those batteries. Currently\, the majority of minerals such as lithium\, cobalt\, nickel\, manganese\, bauxite and others are either produced or processed in foreign countries of concern (e.g.\, China). The current Administration has established a policy of onshoring sourcing of these minerals and their attendant processing in the United States. Recently\, the U.S. Department of Energy announced a $2.3 billion loan to Lithium Americas for development of a lithium carbonate processing plant in Nevada. Additional incentives and funding for those incentives were included in the Inflation Reduction Act of 2022. This seminar will review the background in the growth of this new sector and how domestic industries in mining and mineral processing can potentially benefit from the new and developing federal policies supporting the growth of this industry. \nAttorney Jenni Hicks will serve as a conference co-chair. DESCRIPTION:Attorney Anna Skipper Jewart will present “Preparation for Zoning Hearings Post Brookview Solar: How the Commonwealth Court’s Recent Decision Changed What You Need to Bring to Win” to Pennsylvania Aggregates and Concrete Association’s (PACA) members during their monthly forum meeting on Thursday\, February 8\, 2024. \nOn November 30\, 2023\, the Commonwealth Court decided Brookview Solar I\, LLC v. Mount Joy Township Board of Supervisors\, No. 1055 CD 2022\, 2023 WL 8264544 (Pa. Cmwlth. Nov. 30\, 2023). That case makes zoning applicant’s jobs harder in four key ways. First\, it held that if a zoning ordinance requires a demonstration of compliance with issues typically handled during land development (like stormwater management)\, the applicant cannot wait until a later phase of approval to show it will comply down the line. Second\, if the ordinance requires submission of a report or analysis prepared by an expert\, the applicant must make an expert available for cross examination or the report may be rejected. Third\, evidence of compliance with a zoning ordinance based on hypothetical data may not be enough to show compliance with the ordinance. Fourth\, applicants need to be ready to rebut objectors’ evidence that their use would be a detriment to the health\, safety\, and welfare of the community\, even if the evidence submitted is speculative. DESCRIPTION:Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its Annual Fall Symposium\, October 10-12\, 2023. \nPipeline Attorney Keith Coyle will present “PHMSA LDAR Rulemaking: What’s Proposed and What’s Next.” On May 18\, 2023\, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a proposed rule in the Federal Register that includes significant changes to the reporting requirements in 49 C.F.R. Part 191 and safety standards in 49 C.F.R. Parts 192 for gas pipeline facilities. PHMSA proposed these changes primarily to address certain provisions in the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020\, including a congressional mandate to establish new leak detection and repair (LDAR) requirements for gas distribution lines\, transmission lines\, and certain gathering lines. In this session\, Keith will provide an overview of the key provisions in the proposed LDAR rule and discuss the next steps in the rulemaking process. He will also discuss the potential for subsequent administrative and judicial review of any final LDAR rules prescribed by PHMSA. For more information\, click here.

DESCRIPTION:Environmental Attorney Lisa Bruderly will present “The Newly Finalized WOTUS Definition and How it Will Affect Your Operations” to members of the Energy & Mineral Law Foundation (EMLF) on Thursday\, September 21\, 2023. The U. S. Supreme Court’s Sackett v. U.S. EPA decision\, issued in May 2023\, significantly narrowed the definition of “waters of the United States” (WOTUS) and limited the scope of federally-regulated waters and wetlands. A new regulatory definition of WOTUS\, based on Sackett\, became final on September 8th. During this webinar\, Lisa will discuss the Sackett decision\, the new regulatory definition of WOTUS\, and how these developments will impact the construction of new facilities and operation/maintenance of existing facilities.
