DESCRIPTION:Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its Annual Fall Symposium\, October 10-12\, 2023. \nPipeline Attorney Keith Coyle will present “PHMSA LDAR Rulemaking: What’s Proposed and What’s Next.” On May 18\, 2023\, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a proposed rule in the Federal Register that includes significant changes to the reporting requirements in 49 C.F.R. Part 191 and safety standards in 49 C.F.R. Parts 192 for gas pipeline facilities. PHMSA proposed these changes primarily to address certain provisions in the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020\, including a congressional mandate to establish new leak detection and repair (LDAR) requirements for gas distribution lines\, transmission lines\, and certain gathering lines. In this session\, Keith will provide an overview of the key provisions in the proposed LDAR rule and discuss the next steps in the rulemaking process. He will also discuss the potential for subsequent administrative and judicial review of any final LDAR rules prescribed by PHMSA. For more information\, click here.

Per- and polyfluoroalkyl substances (PFAS) are a group of man-made chemicals that include PFOA\, PFOS\, GenX\, and many other chemicals that all contain fluorine. PFAS have been manufactured and used by a variety of industries for the production of many consumer products around the globe\, including the United States since the 1940s. In recent years\, the United States Environmental Protection Agency (USEPA) and Pennsylvania Department of Environmental Protection (PADEP) have promulgated regulations\, guidance and new maximum contaminate levels (MCLs) in an attempt to reduce the use of these chemicals and increase environmental cleanup standards. DESCRIPTION:Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its 44th Annual Institute\, June 18-20\, 2023. \nLitigation Attorneys Katrina Bowers\, Josh Snyder and Austin Rogers will present “Devil’s Advocate: Crossing the Line of Zealous Advocacy.” As zealous advocates\, attorneys dance on the blade of aggressive advocacy and persuasion.  This presentation will explore this delicate dance through the lens of real-life examples. \nPipeline Attorney Keith Coyle will present “New Federal Gathering Line Regulations.” The Pipeline and Hazardous Materials Safety Administration issued a final rule in November 2021 prescribing new safety standards and reporting requirements for onshore gas gathering lines.  In this session\, Keith\, a former PHMSA Attorney Advisor who represented two pipeline trade organizations during the rulemaking process and in subsequent litigation\, will provide an overview of the new requirements.  As part of his discussion\, he will review the criteria that determine whether an onshore gas gathering line meets the definition of a newly regulated Type C gathering line\, as well as the regulatory requirements that apply to these types of pipelines.  Keith will also cover the requirements that apply to reporting-only Type R gathering lines and some of the other key provisions in the new rules\, including the process for obtaining authorization to use composite pipe material in Type C lines. \nFor more information\, click here. \nKatrina Bowers \nKeith Coyle \nAustin Rogers \nJosh Snyder

SUMMARY:West Virginia Underground Carbon Dioxide Sequestration & Storage Act
DESCRIPTION:Attorney Kip Power will give a presentation on the “West Virginia Underground Carbon Dioxide Sequestration & Storage Act” to the Women’s Energy Network’s West Virginia Chapter on Wednesday\, May 17\, 2023. \nIn 2022\, the West Virginia Legislature enacted the West Virginia Underground Carbon Dioxide Sequestration and Storage Act\, which became effective on May 30\, 2022. It is an important law\, designed as the beginning stages of a platform for the development of sustainable energy operations using existing natural resources in our State and to promote renewable energy projects based on emerging technologies in other areas. Federal and State developments since then have confirmed the need for such a statute and highlighted the need for further regulatory mechanisms to facilitate such projects in West Virginia. DESCRIPTION:Attorney Keith Coyle and Senior Director of Safety Chris Hoidal will present “What’s New in Pipeline Safety: Recent Changes to PHMSA’s Regulations” during the Marcellus Shale Coalition’s Pipeline Safety Seminar on Wednesday\, May 17\, 2023. \nThe significance of pipeline safety has grown dramatically in recent years\, primarily because of the development of the nation’s shale plays and the need for new infrastructure to get gas to market\, specifically in the northeast. This growth in development has spurred new regulations from The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) and its state partners. \nThis seminar will include an update on the recent changes to the pipeline safety regulations\, including PHMSA’s new reporting requirements and safety standards for onshore gas gathering lines. Representatives from PHMSA and the Pennsylvania Public Utility Commission\, Public Utilities Commission of Ohio\, and West Virginia Public Service Commission will also discuss the important initiatives at the federal and state levels.
