The U.S. Department of Energy will soon be reviewing applications and awarding grants for regional Hydrogen Hubs\, perhaps including one in Appalachia\, while private industry continues to actively explore the generation of hydrogen and its use for industrial\, transportation and other uses. Sequestering the carbon is a key component to the development and deployment of hydrogen as an energy source\, particularly in our region. This session will provide the latest developments on the status of IIJA review and funding of hydrogen hubs\, the generation of hydrogen and the market for off-takers\, CO2 and hydrogen pipeline regulation and permitting\, and primacy for UIC permitting of injection wells. \nAttorney Keith Coyle will be the moderator and Senior Director of Safety Chris Hoidal will be a co-panelist for “Pipeline Safety in the Biden Administration.” The Biden administration has issued several significant pipeline safety rules since coming to office in January 2021\, including new safety standards and reporting requirements for onshore gas gathering lines\, as well as new valve installation and rupture detection standards for gas\, hazardous liquid\, and carbon dioxide pipelines. The Administration is also developing new rulemaking proposals to establish enhanced leak detection and repair requirements for gas pipelines and address other congressional mandates. These new rulemakings\, along with the Administration’s focus on environmental issues\, have impacted the regulatory landscape and policy priorities of the Pipeline and Hazardous Materials Safety Administration (PHMSA)\, the federal agency charged with administering the nation’s pipeline safety program. SUMMARY:CCUS Projects & Environmental Law
DESCRIPTION:Babst Calland joins EUCI for “CCUS Projects & Environmental Law\,” November 2-3\, 2022. Carbon capture\, sequestration\, utilization\, and storage (CCUS) will be essential in meeting net zero GHG emission goals. Although Congress has accelerated CCUS as a national decarbonization strategy with billions in new investments\, CCS projects still face many obstacles in the US\, and current federal environmental laws and regulations may often impede progress. The permitting and regulatory approvals needed for a CCUS project are complex and may require a multitude of federal\, state\, and local authorizations. The precise mix of environmental permits\, authorizations\, and/or reviews needed will be project specific. This course will equip you with the details needed to understand the environmental regulatory requirements and landscape for a CCUS project. \nGary Steinbauer \nEnvironmental Attorney Gary Steinbauer will present an “Introduction & Overview of Environmental Regulations Affecting CCUS.” The permitting of a CCUS project is complex and may require a combination of federal\, state\, and local permits or authorizations. For federal review\, a project may require Clean Air Act permits\, an Underground Injection Control permit\, and a Clean Water Act permit\, among others. For offshore projects\, a CCUS project will need to comply with the Marine Protection\, Research and Sanctuaries Act (MPRSA) and the Outer Continental Shelf Lands Act (OCSLA). CCUS projects on federal lands\, supported by federal funds\, or that require certain federal permits and authorizations\, must also comply with NEPA\, Section 7 of the Endangered Species Act (ESA)\, and the National Historic Preservation Act. CCUS developers must also navigate the complex patchwork of state and local laws and regulations. \nGary will also present “Air Quality.” The federal Environmental Protection Agency’s (EPA’s) Greenhouse Gas Reporting Program (GHGRP) requires reporting of greenhouse gas (GHG) data and other relevant information from large GHG emission sources\, fuel and industrial gas suppliers\, and carbon oxide injection sites in the US. Depending on their size and location\, CCUS projects may also have to obtain certain CAA construction or operating permits. Carbon dioxide leakage from a CCUS project could result in violations of its applicable CAA permits.  This session will cover: \n\nGreenhouse Gas Reporting Program and associated CCUS reporting\nPotential Clean Air Act Permits needed for a CCUS project\n\nChris Kuhman \nPipeline Attorney Chris Kuhman will present “Pipeline Safety.” The Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) has primary authority to regulate interstate carbon dioxide pipelines. The PHMSA’s Office of Pipeline Safety regulates the design\, construction\, operation\, maintenance\, and spill response planning for regulated pipelines. \nFor more information\, click here.

Per- and polyfluoroalkyl substances (PFAS) are a group of man-made chemicals that include PFOA\, PFOS\, GenX\, and many other chemicals that all contain fluorine. PFAS have been manufactured and used by a variety of industries for the production of many consumer products around the globe\, including the United States since the 1940s. In recent years\, the United States Environmental Protection Agency (USEPA) and Pennsylvania Department of Environmental Protection (PADEP) have promulgated regulations\, guidance and new maximum contaminate levels (MCLs) in an attempt to reduce the use of these chemicals and increase environmental cleanup standards. DESCRIPTION:Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its Annual Fall Symposium\, October 10-12\, 2023. \nPipeline Attorney Keith Coyle will present “PHMSA LDAR Rulemaking: What’s Proposed and What’s Next.” On May 18\, 2023\, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published a proposed rule in the Federal Register that includes significant changes to the reporting requirements in 49 C.F.R. Part 191 and safety standards in 49 C.F.R. Parts 192 for gas pipeline facilities. PHMSA proposed these changes primarily to address certain provisions in the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2020\, including a congressional mandate to establish new leak detection and repair (LDAR) requirements for gas distribution lines\, transmission lines\, and certain gathering lines. In this session\, Keith will provide an overview of the key provisions in the proposed LDAR rule and discuss the next steps in the rulemaking process.
