SUMMARY:CCUS Projects & Environmental Law
DESCRIPTION:Babst Calland joins EUCI for “CCUS Projects & Environmental Law\,” November 2-3\, 2022. Carbon capture\, sequestration\, utilization\, and storage (CCUS) will be essential in meeting net zero GHG emission goals. Although Congress has accelerated CCUS as a national decarbonization strategy with billions in new investments\, CCS projects still face many obstacles in the US\, and current federal environmental laws and regulations may often impede progress. The permitting and regulatory approvals needed for a CCUS project are complex and may require a multitude of federal\, state\, and local authorizations. The precise mix of environmental permits\, authorizations\, and/or reviews needed will be project specific. This course will equip you with the details needed to understand the environmental regulatory requirements and landscape for a CCUS project. \nGary Steinbauer \nEnvironmental Attorney Gary Steinbauer will present an “Introduction & Overview of Environmental Regulations Affecting CCUS.” The permitting of a CCUS project is complex and may require a combination of federal\, state\, and local permits or authorizations. For federal review\, a project may require Clean Air Act permits\, an Underground Injection Control permit\, and a Clean Water Act permit\, among others. For offshore projects\, a CCUS project will need to comply with the Marine Protection\, Research and Sanctuaries Act (MPRSA) and the Outer Continental Shelf Lands Act (OCSLA). CCUS projects on federal lands\, supported by federal funds\, or that require certain federal permits and authorizations\, must also comply with NEPA\, Section 7 of the Endangered Species Act (ESA)\, and the National Historic Preservation Act. CCUS developers must also navigate the complex patchwork of state and local laws and regulations. \nGary will also present “Air Quality.” The federal Environmental Protection Agency’s (EPA’s) Greenhouse Gas Reporting Program (GHGRP) requires reporting of greenhouse gas (GHG) data and other relevant information from large GHG emission sources\, fuel and industrial gas suppliers\, and carbon oxide injection sites in the US. Depending on their size and location\, CCUS projects may also have to obtain certain CAA construction or operating permits. Carbon dioxide leakage from a CCUS project could result in violations of its applicable CAA permits.  This session will cover: \n\nGreenhouse Gas Reporting Program and associated CCUS reporting\nPotential Clean Air Act Permits needed for a CCUS project\n\nChris Kuhman \nPipeline Attorney Chris Kuhman will present “Pipeline Safety.” The Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) has primary authority to regulate interstate carbon dioxide pipelines. The PHMSA’s Office of Pipeline Safety regulates the design\, construction\, operation\, maintenance\, and spill response planning for regulated pipelines. \nFor more information\, click here.

Federal and State developments since then have confirmed the need for such a statute and highlighted the need for further regulatory mechanisms to facilitate such projects in West Virginia. The U. S. Supreme Court’s Sackett v. U.S. EPA decision\, issued in May 2023\, significantly narrowed the definition of “waters of the United States” (WOTUS) and limited the scope of federally-regulated waters and wetlands. A new regulatory definition of WOTUS\, based on Sackett\, became final on September 8th. During this webinar\, Lisa will discuss the Sackett decision\, the new regulatory definition of WOTUS\, and how these developments will impact the construction of new facilities and operation/maintenance of existing facilities. SUMMARY:Who\, What\, When\, and Why of Authority Rules and Regulations
DESCRIPTION:Municipal Attorneys Betsy Dupuis and Morgan Madden will present “Who\, What\, When\, and Why of Authority Rules and Regulations” to the Pennsylvania Municipal Authorities Association on Wednesday\, October 15\, 2025. Most municipal authorities in the Commonwealth have some iteration of rules and regulations to govern and guide the use of equipment\, services provided\, and authority-owned facilities. Sometimes these regulations simply cover the basics including fees for tapping\, services\, etc.\, and yet other municipalities have more robust regulations that dictate\, for example\, how repairs are to be completed and who is responsible for costs associated with the same. As a general rule\, authorities should regularly review their rules and regulations and ensure that those rules and regulations are sufficient and enforceable based upon current operations and services\, and ensure both the system and the authority are protected from unauthorized actors and a constantly evolving legal and regulatory landscape. This presentation will discuss the source of municipal authorities’ authority\, the framework within which municipal authorities can and should develop rules and regulations and further discuss basics and best practices for promulgating and enforcing sensible authority rules and regulations. \nLearning Objectives: \n\nProvide an overview of the statutory and regulatory rules around authority creation and governing instruments for each authority.\nEmphasize the importance of the underlying relationship between authorities and the entities that created them.\nUnderscore the importance of understanding an authority’s infrastructure– who owns it\, who manages it and who pays when it needs replaced.\nReview best practices for how to develop internal rules and procedures for authority operations\, personnel and municipal relationships.\nDeliver tips and best practices for developing authority rules and regulations for customers and constituents.\n\nFor more information\, click here. \nBetsy Dupuis \nMorgan Madden
