DESCRIPTION:Babst Calland joins the Energy & Mineral Law Foundation (EMLF) for its 44th Annual Institute\, June 18-20\, 2023. \nLitigation Attorneys Katrina Bowers\, Josh Snyder and Austin Rogers will present “Devil’s Advocate: Crossing the Line of Zealous Advocacy.” As zealous advocates\, attorneys dance on the blade of aggressive advocacy and persuasion.  This presentation will explore this delicate dance through the lens of real-life examples. \nPipeline Attorney Keith Coyle will present “New Federal Gathering Line Regulations.” The Pipeline and Hazardous Materials Safety Administration issued a final rule in November 2021 prescribing new safety standards and reporting requirements for onshore gas gathering lines.  In this session\, Keith\, a former PHMSA Attorney Advisor who represented two pipeline trade organizations during the rulemaking process and in subsequent litigation\, will provide an overview of the new requirements.  As part of his discussion\, he will review the criteria that determine whether an onshore gas gathering line meets the definition of a newly regulated Type C gathering line\, as well as the regulatory requirements that apply to these types of pipelines.  Keith will also cover the requirements that apply to reporting-only Type R gathering lines and some of the other key provisions in the new rules\, including the process for obtaining authorization to use composite pipe material in Type C lines. \nFor more information\, click here. \nKatrina Bowers \nKeith Coyle \nAustin Rogers \nJosh Snyder

DESCRIPTION:Babst Calland joins the Marcellus Shale Coalition for its “Understanding PFAS Training” on Thursday\, June 22\, 2023. Per- and polyfluoroalkyl substances (PFAS) are a group of man-made chemicals that include PFOA\, PFOS\, GenX\, and many other chemicals that all contain fluorine. PFAS have been manufactured and used by a variety of industries for the production of many consumer products around the globe\, including the United States since the 1940s. In recent years\, the United States Environmental Protection Agency (USEPA) and Pennsylvania Department of Environmental Protection (PADEP) have promulgated regulations\, guidance and new maximum contaminate levels (MCLs) in an attempt to reduce the use of these chemicals and increase environmental cleanup standards. This training will provide a general overview and understanding of the chemistry surrounding PFAS-related chemicals while discussing sampling and analysis. \nEnvironmental Attorney Matt Wood will present on “The Regulatory Landscape: Intersection of Federal and State Standards.” For more information\, click here.

An Interactive Educational Experience on Diversity and Bias Issues in the Legal Profession.” \nThe 90-minute CLE uses animated vignettes\, polls\, and group discussion to “explore realistic workplace situations and contemplate issues\, viewpoints\, and ethical issues.” The CLE will dive into and explore issues of race and gender within the legal profession. DESCRIPTION:Environmental Attorney Lisa Bruderly will present “The Newly Finalized WOTUS Definition and How it Will Affect Your Operations” to members of the Energy & Mineral Law Foundation (EMLF) on Thursday\, September 21\, 2023. The U. S. Supreme Court’s Sackett v. U.S. EPA decision\, issued in May 2023\, significantly narrowed the definition of “waters of the United States” (WOTUS) and limited the scope of federally-regulated waters and wetlands. A new regulatory definition of WOTUS\, based on Sackett\, became final on September 8th. During this webinar\, Lisa will discuss the Sackett decision\, the new regulatory definition of WOTUS\, and how these developments will impact the construction of new facilities and operation/maintenance of existing facilities. She will also explore the status of existing challenges to the prior definition of WOTUS and new challenges to the most recently-finalized definition.  For more information\, click here.
