This presentation addresses how to use expert witnesses most effectively\, including their expert reports\, qualifications\, and direct and cross examination. \nBetsy Dupuis – “Land Use/Zoning Law Update”\nDevelopment in Pennsylvania\, including most projects involving environmental issues\, is governed by the Municipalities Planning Code and local zoning and land use laws. The application of local land use laws frequently involves the interplay of those laws with state and federal law. This session will review significant land use cases decided over the last year in Pennsylvania\, with a focus on review standards\, standing requirements\, preemption doctrine and constitutional law. Hot topics include the environmental impact of electric vehicles and battery energy storage\, impacts of AI and data centers\, the use of satellite data for air quality and emissions assessments\, and the future of hydrogen as a fuel. \nEnvironmental Attorney Gary Steinbauer will serve as a panel co-chair and panelist for “Air Permitting Programs – Federal and State Implementation Perspectives.” The air permitting programs are implemented under the cooperative federalism paradigm per the Clean Air Act. With the change in administration\, significant changes are expected at EPA OAQPS pertaining to staffing and policy objectives. EPA is also likely to push more obligations to states and local agencies for air programs.
